Experienced Tampa Area Short Sale Attorney Serving Florida

What is a short sale in Florida?

A short sale occurs when the lender agrees to allow you to sell the property for a lesser or “short” amount of what you currently owe on the mortgage. By agreeing to a short sale, the lender will then take the money from the sale of the property instead of pursuing a case to conclusion in court via a foreclosure case and then selling the property at a public auction. A short sale is an alternative to the foreclosure process and considered one of several different loss mitigation options. Short sales are often an alternative to the foreclosure process when the property is “under water” or worth less than the amount owed for the mortgage. A short sale gives the owner an opportunity to avoid the foreclosure process and may be reflected in a better light on your credit report depending on certain aspects of how it is negotiated with the lender.

Why you need an experienced short sale attorney on your side

An attorney can review your situation and give you advice so that you can make the best decision based on your circumstances and the facts of your case. A short sale can be a complicated process where you have to carefully deal with the court system and other additional outside factors involving negotiating with the mortgage company and their attorneys, as well as their representatives. Short sales can be quite complex and time sensitive transactions which should be handled as diligently and efficiently as possible. Often times, dealing with other attorneys, bank representatives and realtors in order to make a short sale possible can be a frustrating and long process. Having an attorney in your corner fighting for you and communicating with the other parties on your behalf can save you a lot of aggravation and emotional distress. Since each case is unique, it is best to approach a short sale by having an experienced real estate attorney talk to you about your options.
